Rahul Gandhi News: What are the perks that will be restored for Rahul?
Rahul Gandhi News: Rahul has a right to a monthly salary of one lakh rupees as an MP for the duration of his time in office. An MP is entitled to an additional Rs 2,000 per day when Parliament is in session.
Additionally, MPs are eligible for a travel allowance that covers train fares. Other benefits include housing, telephone, water, and power, as well as medical services for the MP and their families.
The scope of benefits to which an MP is entitled is set down in the Salaries and Allowances of Members of Parliament Act, 1954.
Rahul Gandhi News: The Housing and Telephone Facilities (Members of Parliament) Rules, 1956 state that “Each Member shall be entitled without payment of a licence fee] to housing accommodation in the form of a flat throughout his term of office: Provided, That where a Member is Allotted Housing Accommodation in the Form of a Bungalow at His Request, He Shall Pay Full Normal Licencing Fee If He Is Entitled To Such Accommodation].”
Before his disqualification, Rahul was designated an official residence at 12 Tughlak Lane in Delhi.
Rahul Gandhi News: What follows in the case?
Rahul Gandhi News: Rahul was found guilty and given a sentence by Chief Judicial Magistrate HH Verma in Surat on March 23, 2023, but the Supreme Court suspended the decisions on August 5.
Rahul had already petitioned the Sessions Court for a stay of the conviction. An Appellate Court may suspend a guilty person’s sentence who has been given a sentence of no more than three years in prison under Section 389 of the Code of Criminal Procedure. Rahul moved the High Court, which likewise dismissed the plea after the Sessions Court rejected it.
Rahul Gandhi News: The SC’s stay essentially means that Rahul’s conviction will be kept in abeyance — as though it did not exist. However, this is only till the Appellate Court decides the case.
An appeal against the conviction is pending before the Surat Sessions Court.
